AP legislative council revived after 22 yrs

The Andhra Pradesh legislative council has come into existence once again after a gap of 22 years. The council was abolished way back in 1985. At a simple function at Raj Bhavan, Governor Rameshwar Thakur administered the oath of office to pro-tem legislative council chairman Puvvada Nageswara Rao on Monday morning.

Soon after, the Governor inaugurated the renovated council building located in the magnificent Jubilee Hall complex in the Public Gardens premises. The pro-tem chairman later administered the oath of office to the other members of the newly-constituted council. Though the council has a total strength of 90 members, only 64 members took the oath on Monday. Elections were conducted for 75 out of the 78 elected seats.

The results of polls to 31 seats from the legislative assembly quota, eight seats each for graduates and teachers and five out of 28 local authorities' constituencies were announced. However, the counting of votes for the remaining 26 local authorities' seats has been put on hold following an inquiry by the Election Commission into alleged irregularities in polling by the ruling Congress supporters in eight districts.

The Governor also filled up the seats of 12 nominated members. The state legislative council was first constituted on July 7, 1958 under Article 168 of the Constitution and inaugurated by the then President Dr Rajendra Prasad. Madapati Hanumantha Rao was its first chairman. The council was abolished by the previous Telugu Desam government on May 31, 1985 since the then chief minister N T Rama Rao felt that it was redundant and caused a drain on the state exchequer. However, it is believed that the real reason was that NTR found it difficult to push through controversial legislations and policy decisions in the Upper House which was at that time dominated by the Congress. Incidentally, it was Congress government at the Centre under Rajiv Gandhi's stewardship that enacted AP Legislative Council (Abolition) Act, despite stiff opposition from state Congress leaders who argued that the scrapping the council was against the party's interests in the state. Later, in 1990, the then Congress government made an attempt for revival of the council but in vain. Subsequently, the Congress again promised revival of the council in its manifesto for 2004 assembly polls.

After snatching power from the Telugu Desam, the Congress made fresh efforts to revive the council. Basing on a resolution passed by the state legislative assembly, the UPA government enacted the AP Legislative Council Bill in December 2005 for revival of the council. The Bill received the President's assent in January 2006 but it took almost a year for the Election Commission to complete the formalities for constitution of the council and for conduct of elections to fill the seats under various categories in the reconstituted Upper House. After delimitation of graduates and teachers' constituencies, the enrolment of voters for these seats was done. Elections to teachers, graduates and local authorities' constituencies were held on March 17 this year.

The polls for the seats from Assembly quota were held on March 22. The election of the legislative council Chairman is scheduled on April 3 morning after receipt of nominations till Monday evening. Senior Congress member A Chakrapani is likely to be unanimously elected as the first chairman of the revived council.

Though the members of the reconstituted council include a number of former ministers, ex-legislators and former parliamentarians mainly belonging to the Congress, only seven members served as members of legislative council earlier. The MLCs enjoy the same privileges and perks as the members of the legislative assembly.

The legislative council will have five special committees of its own relating to privileges, ethics, rules, papers laid and assurances, while the other committees will be common for both the Houses. The legislative council, which is akin to the Rajya Sabha, will have only have an advisory role and no veto power. It has to approve all the Bills that are passed by the assembly. The council can only return a particular bill to the assembly for reconsideration.

Dr. Nageshwar: Winner of MLC elections from HYD-RR-MBNR Graduates Constituency

Counting for MLC elections finished early morning today. I stood in12th poistion among 57 contestants from Hyderabad-Ranga Reddy-MahbubNagar Graduates Constituency.

Dr. Nageshwar, Journalism Professor from OU managed to win theelections silently. He had support from CPI/CPM party as well assupport from several trade unions and employee unions. Though therewere several contestants spent more than crore rupees they could notmake an impact in the elections. Atlast Voters has proved that theyare the "KINGS". With his election tag line " Money Power or MindPower - Medhavula Sabhaku Medhavulanu Pampandi" Dr Nageswar hasproved that Mind Power is superior than Money Power

MLC Elections: Thank you one and all !!!

I wish you and your family members a happyUGADI. Polling for MLC elections for Hyderabad-Ranga Reddy-MahbubNagar Constituency happened on 17th. Elections went on peacefully. About 1.10 lakh voters have utlised their vote in the election among2.12 lakh graduate voters.

As you all know that I have contested fromthe same constituency. I was the youngest among all MLC contestantsand only one from IT industry who took initiation to contest in the elections. I have made a great imapact in the elections by spending very less amount and utlised all the resources like Internet, email,word of mouth, SMS, friends, well wishers and Media.

Andhra Pradesh Legislative Council polls too expensive!

Finance Minister K Rosaiah has been saying that the restoration of Legislative Council and the recurring expenditure on running the Upper House will not cause much burden on the exchequer: it would not be more than Rs 7 crore to Rs 8 crore per annum, which he says is a peanut compared to the Rs 50,000 crore annual budget. However, if one looks at the way the money being spent by the candidates fighting to get into the Legislative Council, one is sure to get a rude shock. The overall expenditure being incurred by the candidates on the campaigning will be not less than Rs 100 crore. According to sources, the Congress candidates had to shell down lakhs of rupees to please their bosses and get the tickets, leave alone the campaign expenditure. And the Telugu Desam candidates, too, are not lagging behind. Most of these candidates hail from affluent sections and hence, are not hesitating to spend money like water.

A number of candidates fighting for the graduates' constituency represent Corporate Colleges, which had made crores of rupees in the last five or six years. And they donated lakhs of rupees to Telugu Desam as well as the Congress. What is more surprising is that even candidates fighting from teachers' constituencies are spending huge amounts. The teachers' union leaders are collecting donations from the teachers towards electioneering. And the style of electioneering is no less than that of an MLA election. Unlike in the past, when the Council candidates used to campaign through personal canvassing or by word of mouth, this time, the candidates are putting up banners, posters and huge cut-outs and even hiring vehicles in large numbers.

Since there is no restriction by the Election Commission of India on the expenditure on MLC elections (unlike in the case of Assembly elections), the candidates are going overboard to spend money. It remains to be seen how these candidates recover their expenditure after getting elected!!

Filed my Nomination papers for MLC Elections from Hyderabad-Ranga Reddy-Mahbubnagar Constituency

I ( Allipuram Rajasekhar Reddy) am glad to inform all of you that I have filed my nominations for MLC Elections(Shasana Mandali) from Hyderabad-Ranga Reddy-Mahbub Nagar Graduates Constituency on 21st Wednesday at around 11.45 AM to the AP legislative Coucil Elections Asst Returning Officer Mr. Ravi Babu. The elections will be held on March 17th, 2007. I have filed 2 sets of nomination papers.

There are about 50 supportes, mostly Software Engineers from different companies of mine were there with me at the time of nomination. I thank you one and all for making it to the Nomination office at MCH Main Building, Liberty especially Mr. Thirupathi Reddy from DELL, JMD Ramakrishna Reddy, Madhav Reddy from BSNL, Brahmananda Reddy, Santosh, Sudhakar, Laxma Reddy Ramana Reddy, Marreddy Krishna Reddy, Thota Srinivas Reddy
etc. I also thank Murali Krishna, Mr. Govnid for helping me with the filing of nominations. The Next day of the nomination, My photo has appeared in Eenadu in Hyderabad District edition.

As the nomination is filed, I would request everyone to help me to campaign for My MLC elections. I feel that I stand in the top 5 contestants at this moment and If I work hard with all your support, I have very good chances of winning, provided if you all are with me. I need your time, suggestions, ideas, help, contributions, knowledge, and contacts to go ahead and do aggressive campaign. All of you should educate all the voters on voting process and polling date and request everyone to go for voting on 17th march 2007.

(b) the 23rd February 2007 (Friday), as the date for the scrutiny of the nominations;
(c) the 26th February 2007 (Monday), as the last date for the withdrawal of candidatures;
(d) the 17th March 2007 (Saturday), as the date on which a poll shall, if necessary, be taken; and
(e) the 26th March 2007 (Monday) as the date before which the election shall be completed; and
(B) fixes the hours from 8:00 A.M. to 4:00 P.M., as the hours during which the poll shall, if necessary, be taken , on the date specified above, for the election.
The term of the members elected at the above elections shall be determined after the completion of the election in accordance with the provisions of Section 156(1) of Representation of People Act, 1951.

Schedule:Elections to the Legislative Council of Andhra Pradesh by MLAs, for Local Authorities' Constituencies and Graduates` & Teachers` Constituenci

The Andhra Pradesh Legislative Council Act, 2005 was passed on 11-01-2006 paving way for the constitution of a new Legislative Council in the State after a gap of nearly 20 years, comprising of 90 members - 31 to be elected by MLAs, 31 to be elected from Local Authorities’, 8 from Graduates’ and 8 from Teachers’ Constituencies and the remaining 12 members to be nominated by the Governor. For holding elections from the Local Authorities’, Graduates’ and Teachers’ Constituencies, the Constituencies were required to be delimited first and then the electoral rolls for the Constituencies prepared. Required data for this purpose was obtained from the State Govt. and analyzed. A meeting was held on 6-9-06 with the political parties of the State to have their views in the matter before finalizing the Delimitation Order which was notified by the President on 26-9-06 and work relating to preparation of rolls started immediately thereafter.

Whereas all the 8 Graduates’ and 8 Teachers’ Constituencies are single member constituencies,out of the 23 Local Authorities’ Constituencies of the State, the following eight are double member constituencies making the total seats from these Constituencies thirty one (31): -
(1) Visakhapatnam Local Authorities’, (2) East Godavari Local Authorities’, (3) West Godavari Local Authorities’, (4) Krishna Local Authorities’, (5) Guntur Local Authorities’, (6) Chittoor Local Authorities’, (7) Anantapur Local Authorities’, and (8) Hyderabad Local Authorities’.

The Commission is consistently following the policy of holding elections to the Local Authorities’ Constituencies only when seventy five percent of the constituent local bodies and again seventy five percent of the total electorate in each local authorities’ constituency are in existence.

As far as Hyderabad Local Authorities’ and Ranga Reddy Local Authorities’ constituencies are concerned, the term of Municipal Corporation of Hyderabad is expiring on 10-02-07 resulting in virtual non-existence of total electorate in that constituency and the electors in position with respect to Ranga Reddy Local Authorities’ Constituency are only about 63% as on date which is against the policy of the holding elections from such constituencies.

In view of this, the Commission has decided not to hold elections for the three seats from these two Local Authorities’ Constituencies (two seats from Hyderabad LAC and one from Ranga Reddy LAC) till the strength of their members as well as local bodies in position are 75% or more. Now, as the rolls have finally been published in all the Graduates’ and Teachers’
constituencies, the Commission has decided to hold the elections to fill up all the remaining 75 seats in Andhra Pradesh Legislative Council i.e. 8 from Graduates’ Constituencies, 8 from Teachers’ Constituencies, 28 from Local Authorities’ Constituencies (barring the two Local Authorities Constituencies of Hyderabad and Ranga Reddy) and 31 seats of Members to be elected by MLAs as per the programme given in the Annexure.

The term of the members elected at the above elections shall be determined after the completion of the elections, in accordance with the provisions of Section 156(1) of the Representation of the People Act,1951.
